Evata driver terms
Version of 3 November 2026, the current version.
These terms apply while Evata is open by invitation. We will ask you to accept new terms before Evata opens to everyone.
1. Who we are
Evata UK Limited, registered in Scotland, company number SC688260, registered office c/o Global Accountancy Practice, 10 Allison Street, Glasgow G42 8NN, VAT number GB 496 0062 83. Contact us at https://www.evata.co.uk/get-in-touch.
2. Your account
- You must be 18 or over.
- You sign in with a code texted to your UK mobile. One account per mobile number.
- While Evata is open by invitation, only invited numbers can use it.
- Keep your phone secure. You are responsible for use of your account until you tell us it has been misused.
- Keep your email address up to date and confirmed. We send receipts and account messages there.
- You can have one vehicle on your account. A vehicle from a business you drive for replaces your own.
- You accept these terms when you create your account or accept them in the app. We record which version you accepted and when.
3. Charging
- You can charge at the sites the app shows as open to you. We do not own most sites or chargers and cannot promise they are open, working or free.
- Some depots ask to see your Check in pass. It is for you alone.
- Bookings are in 30-minute slots, up to 90 minutes, up to two weeks ahead, and are free. Cancel any booking you will not use so others can have the bay. A booking does not lock the charger.
- Follow each site's rules and staff instructions, park in a bay only while charging, use only suitable working chargers, put the cable back, move your vehicle when finished, and report damage or injury straight away.
- You are responsible for damage you cause by breaking these terms or a site's rules, or through carelessness.
- Do not let anyone else use your account, pass or card, misuse or interfere with Evata, a charger or a site, or give us false information.
- We may refuse to start a charge, for example if a site is not open to you, its rules are unconfirmed, your access is stopped, or your payment is not set up or overdue.
4. Prices
- The app shows the price, including VAT and any time-based or fixed charges, before you start.
- What you pay is based on the charger operator's final record of the charge.
- There is no subscription or joining fee and we charge no overstay fee.
- If a business pays for your charging, we bill that business and it can see your charging.
- If a charge is wrong, tell us and we will put right anything we got wrong. Corrections from an operator are passed back to whoever paid.
5. If you pay for your own charging
- You buy your charging from us, not from the site or the charger's operator.
- You need a confirmed email and a card saved in the app. Card payments are handled by Stripe.
- You choose pay as you go or a prepaid balance. If a business could also pay for a charge, you choose who pays and the app shows it before you charge.
Pay as you go. You authorise us: "I authorise Evata to charge this card after each charging session for the cost of that session, as shown in the app." We charge your card after each charge. If a payment fails, you owe it and cannot charge again until you pay it in the app. We do not retry your card.
Prepaid balance.
- Top-ups are £5 to £200, with no fee. Credit is added when your bank confirms the payment.
- You need at least £10 to start a charge.
- A charge is taken in full, even if it takes your balance below zero. You then owe the difference, and top-ups pay it off first.
- Your balance can only be spent on charging from us. It is not a bank account, earns no interest, cannot be transferred or withdrawn, does not expire, and is not protected by the Financial Services Compensation Scheme.
- Automatic top-up is optional. If you turn it on, you authorise us: "I authorise Evata to charge this card automatically when my balance falls below the amount I set, until I turn auto top-up off. I can turn it off at any time in the app." We charge the amount you set, once each time your balance falls below your trigger.
Card disputes. While you dispute a payment with your bank, you cannot start a charge. If your bank reverses the payment, you owe us the amount and can pay it in the app.
6. Stopping access and closing your account
- We may stop you or a vehicle booking, charging or checking in, for example for safety, a suspected breach of these terms or a site's rules, or fraud. Contact us to ask why or to challenge it. A charge already running is not stopped.
- A business that pays for your charging can end your access through it.
- We may close your account for serious or repeated breach, fraud or legal reasons, or on 30 days' notice for any other reason.
- You can close your account at any time in the app (Profile, Close account) or through our contact page. You are signed out at once and cannot sign in again. Money you owe stays owed.
- When your account closes, we refund your balance to the cards you topped up with, newest first, free of charge. Anything we cannot return to a card we return another way. This is the only way to get your balance back.
- If you are a consumer, you can cancel within 14 days of opening your account by closing it. We refund your balance but not charging you have already had.
- We handle your personal information as described at https://www.evata.co.uk/privacy.
7. Changes
We will give you 30 days' notice of significant changes and ask you to accept them in the app. If you do not, you can close your account first. Changes that only benefit you, or that law or security require, can take effect sooner.
8. Liability
- We are liable for foreseeable loss caused by our breach of these terms or lack of reasonable care.
- Our total liability is limited to the greater of £500 and what you paid us in the 12 months before the event causing the loss.
- We are not liable for events outside our reasonable control, such as power cuts, faults in chargers or networks we do not run, or site closures.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else the law does not allow, or affects your legal rights as a consumer.
9. General
- You cannot transfer your account or balance. We may transfer these terms to another business without reducing your rights.
- If part of these terms is unenforceable, the rest still applies. Not enforcing a term straight away does not waive it. Only you and we have rights under these terms.
- Complaints: contact us and we will try to put things right.
- These terms are governed by Scots law and the Scottish courts have jurisdiction. If you are a consumer living elsewhere in the UK, you can also use your local courts and keep your local consumer rights.
